Terms and Conditions 2025 – STAAL&KRACHT

 

Article 1 – Definitions
In these terms and conditions, the following definitions apply:
1.       STAAL&KRACHT, t
he sports provider located at Van Deventerstraat 48–50, 3113AL Schiedam,

          registered with the Dutch Chamber of Commerce under number 57587434.

 2.      Athlete: The natural person who has registered via the website, mobile device, or otherwise, and has

          entered into an agreement with STAAL&KRACHT.
3.       Agreement: The contract between STAAL&KRACHT and the Athlete regarding membership and the use of                facilities, classes, and services.

 

Article 2 – Applicability
2.1 These terms and conditions apply to all agreements, offers, activities, classes, and facilities of                                    STAAL&KRACHT, unless explicitly agreed otherwise in writing.

2.2 By registering, the Athlete agrees to these terms and conditions.

 

Article 3 – Liability and Indemnification
3.1 Participation in STAAL&KRACHT activities is entirely at the Athlete’s own risk.

 

3.2 STAAL&KRACHT, its management, staff, and instructors are not liable for:
a.     Any personal or physical injury;
b.     Damage or loss of personal belongings;
c.     Consequential damages of any kind.

 

3.3 The Athlete is liable for any damage caused to third parties, STAAL&KRACHT property, or third-party property          due to intent, negligence, or careless behavior.

 

3.4 The Athlete fully indemnifies STAAL&KRACHT against any third-party claims related to participation in activities.

 

Article 4 – Code of Conduct and Termination Due to                    Misconduct
4.1 The Athlete must strictly adhere to the following code of conduct:
•     Keep the gym clean and tidy
•     Put away equipment after use
•     Respect others, equipment, and coaches
•     Support and help each other
•     Leave your ego at the door

 

4.2 STAAL&KRACHT reserves the right to deny access and/or terminate the agreement immediately if the Athlete:
a.     Violates the code of conduct
b.     Misbehaves or causes disruption
c.     Acts contrary to the agreement

 

4.3 In the cases mentioned in Article 4.2, the Athlete is not entitled to any refund or compensation.

 

Article 5 – Classes and Schedule Changes
5.1 Membership types are based on monthly cycles.
5.1.1 A 12-month contract will automatically convert to a monthly cancellable membership unless the Athlete r                  equests renewal.

 

5.2 STAAL&KRACHT may change opening hours and schedules.
5.2.1 Each member receives a unique electronic access code for 24/7 access. Upon cancellation, the code will be            deactivated.

 

5.3 During holidays and official public holidays, STAAL&KRACHT may be closed or operate on a modified                      schedule without refund of class fees.

 

5.4 Group classes may be canceled or rescheduled due to insufficient participants, instructor illness, force majeure,        or other circumstances.

5.5 In case of prolonged instructor absence, STAAL&KRACHT will make efforts to arrange a replacement.

 

Article 6 – Membership, Cancellation, and Changes
6.1 Memberships are strictly personal and non-transferable.

 

6.2 Cancellation must be submitted in writing or digitally, with a notice period of one full calendar month, starting            from the activation date of the subscription in the following calendar month.

 

6.3 Memberships are automatically renewed (recurring payments) for an indefinite period unless canceled or modified in time via the member portal on the STAAL&KRACHT website.

 

6.4 Changes to membership types must be submitted in writing, via email, or through the member portal and will            take effect on the first day of the following calendar month. No refunds will be issued.

 

Article 7 – Payment and Collection
7.1 STAAL&KRACHT reserves the right to annually index membership fees.

 

7.2 Membership fees are preferably paid via direct debit on the agreed collection date.
7.2.1 Direct debit can be arranged via the website or the ‘Pay n Plan’ app.
7.2.3 All other payments are made digitally via the website, app, QR codes, or digital checkout. Cash payments are          possible but not preferred.

 

7.3 If you dispute a direct debit but are bound by the terms and reverse the payment, a €10 administration fee will          be charged. These fees are incurred via our financial platforms.

 

7.4 Membership fees remain due even if the Athlete does not use the gym/classes, unless otherwise agreed in              writing.

7.5 If payment is not received, STAAL&KRACHT may transfer the claim to a third party, with all (extra)judicial costs        borne by the Athlete.

 

Article 8 – Force Majeure
8.1 Force majeure refers to any circumstance beyond STAAL&KRACHT’s control that prevents full or partial                    fulfillment of the agreement.

 

8.2 In case of force majeure, STAAL&KRACHT may suspend or terminate its obligations without liability for                    damages.

 

Article 9 – Applicable Law and Disputes
9.1 All agreements between STAAL&KRACHT and the Athlete are governed exclusively by Dutch law.

 

9.2 Disputes will be submitted exclusively to the competent court in the district where STAAL&KRACHT is located.

 

Article 10 – Miscellaneous
10.1 Rental of the space for personal training by coaches not affiliated with STAAL&KRACHT is subject to a                      separate contract with different financial terms and conditions.

 

10.2 An electronic key is created upon subscription and is a personal code for accessing the gym. In case of                    misuse, the holder of the code remains responsible for any consequences. A new code can be issued in case          of loss. If the code is lost or forgotten, it will be blocked.
